The patch was taken from the extreme folder I play under and it works fine for me. Or maybe you didn't get the latest patch.

Actually, I don't mind the way it works for me. The fact that the merchant window doesn't open when I hail them is better, in my opinion, because it got to be a PITA to have to close the window when all I wanted was to just hail them.
